Nogglets terms of service
The rules for using Nogglets and its optional in-app purchases.

About these terms
These terms are an agreement between you and Family Friendly, Inc., a Delaware corporation in Austin, Texas (“we”, “us”), about your use of Nogglets: 3D Memory Puzzle (“Nogglets”, “the app”). By downloading or using the app you agree to them. If you do not agree, do not use the app.
You acknowledge that these terms are between you and us only, and not with Apple Inc. (“Apple”). Apple’s standard Licensed Application End User License Agreement also applies to the app. If these terms conflict with Apple’s Standard EULA, Apple’s EULA controls only as to Apple’s rights and obligations; otherwise these terms control.
License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download, install and use the app on Apple-branded devices you own or control, for your own non-commercial use, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including Family Sharing where applicable). You may not copy, modify, reverse engineer, decompile, sell, rent, sublicense or distribute the app, or use it to build a competing product, except where the law says you may despite this restriction.
Price and purchases
Nogglets is a free download. It offers optional one-time, non-consumable in-app purchases:
- a content unlock, which adds Endless mode and more puzzles; and
- optional cosmetic items (skins, emotes and celebration effects) and bundles of them.
There are no subscriptions and no consumable in-game currency. Prices are shown in the app before you buy and are charged by Apple through your Apple Account. Purchases are tied to your Apple Account and can be restored on your other devices with Settings > Restore Purchases.
Refunds are handled by Apple under its policies. To ask for one, use Report a Problem or contact Apple Support. We cannot issue refunds for App Store purchases ourselves.
Your data
The app stores your progress and settings on your device. We do not keep a copy on our servers and cannot recover it for you. It is removed if you delete the app, unless it is included in a device backup you restore (such as iCloud Backup). Purchases are separate: they are tied to your Apple Account and can be restored with Settings > Restore Purchases. Our privacy policy explains what the app does and does not collect.
Acceptable use
Do not use the app unlawfully, interfere with or attempt to circumvent how it works or how purchases are verified, or use it in a way that infringes anyone’s rights.
Ownership
The app and everything in it, including the Nogglets characters, artwork, animations, sounds, music, code, names and logos, belong to Family Friendly, Inc. or its licensors and are protected by copyright, trademark and other laws. These terms give you a license to use the app. They do not transfer any ownership. Cosmetic items you buy are a license to use them inside the app, not ownership of the underlying content.
Feedback
If you send us ideas or suggestions, we may use them without owing you anything.
Updates and availability
We may update, change or remove features, or stop offering the app, at any time. We will try to give notice before removing something you have paid for, and your purchases remain tied to your Apple Account subject to Apple’s policies.
Disclaimer
The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the app will be uninterrupted or error-free. Some places do not allow these exclusions, so they may not apply to you.
If the app fails to conform to any applicable warranty, you may tell Apple, and Apple will refund the purchase price of the app (if any). To the extent the law allows, Apple has no other warranty obligation for the app. Apple is not responsible for maintenance and support for the app, for claims about the app, or for third-party intellectual property claims. We are responsible for those matters.
Limitation of liability
To the fullest extent the law allows, Family Friendly, Inc. and its officers, directors, employees and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the app. Our total liability for any claim relating to the app is limited to the greater of (a) the total amount you paid for the app and in-app purchases in the twelve months before the claim arose or (b) US$50. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Termination
These terms last until ended. You can end them at any time by deleting the app. We may end your license if you break these terms, and you must then stop using the app. The sections on ownership, disclaimers, limitation of liability and governing law survive termination.
Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and the courts located in Travis County, Texas will have exclusive jurisdiction over disputes, except where your local consumer law gives you rights that cannot be waived. Apple and its subsidiaries are third-party beneficiaries of these terms, and on your acceptance of them Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
Apple-specific terms
We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws. If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
You represent that you are not located in a country subject to a U.S. Government embargo or designated by it as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must also follow any third-party terms that apply when you use the app, such as your wireless data service agreement.
Changes to these terms
We may revise these terms. We will post the new version here with a new “last updated” date. For material changes we will also tell you in the app. Continuing to use the app after a change means you accept it.
